Health officials warn of spiraling HIV in Athens

ATHENS, Greece (AP) ? Health officials warn that the Greek capital is seeing an alarming increase in new HIV infections, particularly among intravenous drug users, as the country struggles through a protracted financial crisis in which funding has been slashed for health care and drug treatment programs.

Officials said while there were about 10-14 new HIV infections per year among Athens drug users from 2008 to 2010, that number shot up to 206 new cases last year and 487 new cases by October this year ? a 35-fold increase.

Epidemiology and preventive medicine professor Angelos Hatzakis described the situation as a "big and rapidly developing epidemic in Athens."

Marc Sprenger, director of the European Center for Disease Prevention and Control, said the situation must be dealt with quickly to prevent it from spiraling further.

Bopha intensified into a typhoon today, Nov. 30, as it continues to affect the islands in Micronesia in the western North Pacific Ocean. NASA's TRMM satellite captured rainfall data of Bopha and noticed "Hot Tower" thunderstorms as it was intensifying from a tropical storm into a typhoon.

When NASA and the Japanese Space Agency's Tropical Rainfall Measuring Mission (TRMM) satellite passed over Bopha twice on Nov. 29, and the later data showed that the area of heaviest rainfall had expanded and was still south of the center of circulation. The heaviest rainfall was occurring at a rate of 2 inches/50 millimeters per hour.

TRMM data also showed several "hot towers" within Tropical Storm Bopha. A "hot tower" is a tall cumulonimbus cloud that reaches at least to the top of the troposphere, the lowest layer of the atmosphere. It extends approximately nine miles (14.5 km) high in the tropics. The hot towers in Bopha were over 9.3 miles (15 km) high. These towers are called "hot" because they rise to such altitude due to the large amount of latent heat. Water vapor releases this latent heat as it condenses into liquid. NASA research shows that a tropical cyclone with a hot tower in its eyewall was twice as likely to intensify within six or more hours, than a cyclone that lacked a hot tower. It was after TRMM spotted the hot towers in Bopha that the storm intensified into a typhoon.

On Nov. 30 at 10 a.m. EST (1500 UTC/1 a.m. CHST local time on Dec. 1), the National Weather Service in Guam urged residents in Koror, Kayangel and Sonsorol in the Republic of Palau and Yap Island and Ngulu Atoll in Yap State to prepare for typhoon conditions. A typhoon watch remains in effect for Ngulu in Yap State and Koror and Kayangel in the Republic of Palau. A tropical storm watch remains in effect for Yap Island in Yap State and Sonsorol in the Republic of Palau.

At 1 a.m. CHST local time on Dec. 1, (1500 UTC/10 a.m. EST, U.S. on Nov. 30) the center of Typhoon Bopha was located near latitude 4.4 degrees north and longitude 143.8 degrees east. Bopha's center was about 510 miles east-southeast of Ngulu, about 525 miles southeast of Yap, and 675 miles east-southeast of Koror Palau and Kayangel. Bopha's maximum sustained winds remain at 75 mph (120.7 kph) and the storm is expected to slowly intensify over the next day. Typhoon Bopha is moving west-northwestward at 12 mph and little change is expected in this movement through Saturday, Dec. 1.

According to the National Weather Service in Guam, "Typhoon force winds extend outward up to 20 miles from the center and tropical storm force winds extend outward up to 85 miles from the center."

Typhoon Bopha is expected to continue moving toward west-northwest. The National Weather Service official forecast track takes Bopha south of Ngulu and very close to the islands of Koror and Kayangel in the Republic of Palau. As Bopha draws closer and intensifies, winds could reach typhoon intensity (as high as 74 mph/ 64 knots/119 km/h). Surf will be very rough and rainfall can reach up to 4 inches on Saturday and up to an additional 6 inches on Sunday/Monday. Residents can expect local flooding and mudslides. Lies and the Lying Tobacco Company Liars Who Told Them

151357873 Will you be seeing tobacco company CEOs on your television admitting to lying during the commercial breaks of A Charlie Brown Christmas? Not quite.

It?s pretty well established that the big tobacco companies have not always been entirely honest with the American public about the dangers of smoking. Now, a federal judge has said that they will have to pay for television, online, and print advertisements that will say the companies downright lied to the public about smoking?s health effects.

The ruling stemmed from a case the Department of Justice brought back in 1999 against the tobacco companies, for conspiring in a ?scheme to defraud smokers and potential smokers,? by misleading the public about the addictive nature of cigarettes and the diseases that they can cause. The case went to trial in 2004, and Judge Gladys Kessler ruled against the tobacco companies two years later, ordering, among other things, that the companies would have to pay to correct the misleading record they?d built, because they broke federal anti-racketeering laws.

Since then, the case has gone through six years of appeals and arguments over what exactly the statements should say. The tobacco companies resisted what they called ?forced public confessions,? claiming that the order violated their First Amendment rights. This week, Judge Kessler rejected those arguments. And so, every tobacco-paid ad will begin by saying that a federal court found that the companies ?deliberately deceived the American public.? The statements go on to cover the dangers of smoking, the addictive nature of nicotine, the equally dangerous effects of low-tar and light cigarettes, the companies? efforts to make cigarettes more addictive, and the harm caused by secondhand smoke. Some of the facts that will be included in the statements include:

  • More people die every year from smoking than from murder, AIDS, suicide, drugs, car crashes, and alcohol, combined.
  • Smoking causes heart disease, emphysema, acute myeloid leukemia, and cancer of the mouth, esophagus, larynx, lung, stomach, kidney, bladder, and pancreas.
  • Defendant tobacco companies intentionally designed cigarettes to make them more addictive.
  • Secondhand smoke kills over 3,000 Americans each year.
  • Children exposed to secondhand smoke are at an increased risk for sudden infant death syndrome (SIDS), acute respiratory infections, ear problems, severe asthma, and reduced lung function.

Now that the exact wording is settled, will you be seeing tobacco company CEOs on your television admitting to lying during the commercial breaks of A Charlie Brown Christmas? Not quite. The original 2006 order required the statements to be published on corporate websites as well as in full-page ads in major newspapers and ads on major television networks. Those venues are now being re-evaluated, however, because the state of media and advertising has changed so drastically in just the past six years. It will be another few months before we know where the undoing-the-lie ads will appear.?

Mustache transplants on the rise in Middle East

A mustache is a symbol of power and respect in some parts of the world. (KREM.com)Movember is coming to a close in the U.S., but men in the Middle East are reportedly seeking out mustache transplants in order to give their facial hair a thicker and fuller appearance.

"For some men who look young and junior, they think (a mustache) is a must to look senior ... more professional and wise," Turkish plastic surgeon Selahattin Tulunay told CNN. "They think it is prestigious."

Tulunay says he now performs 50 to 60 mustache implants per month on patients who largely hail from the Middle East and travel to his country as "medical tourists."

Several other surgeons told CNN they have seen an increasing number of patients seeking the procedure, with most patients ranging in age from 30 to 50.

The procedure is known as follicular unit extraction and involves removing follicles from areas of the body with dense hair growth and implanting them in the desired mustache area.

Altogether, the outpatient procedure costs about $7,000.

Tulunay tells CNN that his patients often request mustache styles worn by celebrities or historical figures. "They have some celebrities as role models," he said, saying Turkish singer and actor Ibrahim Tatlises is a favorite.

In the U.S. the mustache is taken somewhat less seriously. Groucho Marx was recently voted as having America's favorite facial hair.

In May, an Indian man was recognized by Guinness World Records as having the world's longest mustache at 14 feet.

The mustache is a fixture of the Arab world, dating to the Ottoman Empire. And there have been recent examples of the mustache playing a role in power politics. In 2008 the Jerusalem Post reported that Gaza militants shaved the mustache off a Fatah rival they had abducted

Breakthrough in the understanding of embryonic stem cells

ScienceDaily (Nov. 30, 2012) ? A significant breakthrough in the understanding of embryonic stem cells has been made by scientists from the Smurfit Institute of Genetics at Trinity College Dublin. The Trinity research group led by Dr Adrian Bracken and funded by Science Foundation Ireland, has just published their findings in the journal, Nature Structural & Molecular Biology.

The new research describes the process whereby genes that are 'on' in embryonic stem cells are switched 'off'. This process is essential in order to convert embryonic stem cells into different cell types such as neurons, blood or heart cells and therefore represents an important breakthrough in the area of regenerative medicine.

The research encompasses both embryonic stem cell research and epigenetics. Embryonic stem cell research is focused on a particular type of cell that is capable of generating the various tissues in the body; for example, muscle, heart or brain. It is particularly relevant due to its potential for regenerating diseased tissues and organs and for the treatment of a variety of conditions including Parkinson?s disease, diabetes and spinal cord injury

Epigenetics explains how cells in your body with exactly the same genes can be so different functionally. For example, a neuron and a muscle cell look and act very differently, yet contain exactly the same genes. The study of epigenetics has helped us understand that every type of cell has its own unique pattern of genes that are either switched 'on' or 'off'. Different types of cells arise therefore due to these differences.

This new research explores the role of a protein termed a ?Polycomb group protein? called PHF19 in mouse embryonic stem cells. Gerard Brien, the lead author on the paper, and PhD student in the laboratory of Dr. Adrian Bracken demonstrated that without PHF19, embryonic stem cells are incapable of generating specialised cells such as those of the heart, lung or brain. He next established that PHF19 plays a critical role in switching the embryonic stem cell genes from an 'on' to an 'off' state during conversion into specialised cells. PHF19 does this by reading an ?epigenetic mark? called H3K36me3, which is only found on genes that are 'on'. It then recruits additional ?Polycomb? and other proteins, which replace H3K36me3 with another mark, H3K27me3, that is found on genes that are 'off'.

Commenting on the findings, Dr. Bracken stated: ?This discovery about PHF19 is an important step forward in our understanding of how stem cells specialise. In addition to its relevance in regenerative medicine, it may also have implications in future cancer therapies. We are also studying a related ?Polycomb group protein? called EZH2, which is mutated in lymphoma, a type of blood cancer. Several new drugs have been developed to target EZH2 and treat these patients. Our new results suggest that these patients could also be treated by inhibitors of PHF19. This ongoing work is supported by funding from Science Foundation Ireland?.

Self-Grading?Mayor?s Office Gives Itself Mostly High Marks on Transportation

Last month, the Mayor?s Office released a report ranking itself on how it achieved, or didn?t achieve, its stated transportation goals over the last seven and a half years. Rather than traditional grades, the report gave the offices green (for ?completed?), yellow (for ?in the works?) or red (for ?didn?t/won?t happen) on a variety of transportation issues.

As speculation on whether the ?Subway Mayor? is going to move on to Washington, D.C. to be the next Secretary of Transportation intensifies, this report could be a resume of sorts for the Mayor. If the rumored appointment does happen, a report released to the yawn of the local press corps could become fodder for national debate. While the report does have many more green dots than yellow or red, after all what politician releases a report that shows staff underperforming, there is enough red and yellow to give the report an honest look. And after all, transportation is one of the areas where Villaraigosa and his team excel.

To nobody?s surprise, the Mayor?s Office gives itself high marks on transit expansion, noting the passage of Measure R in 2008 and the less-exciting but perhaps just-as-important Proposition B in 2006. Both the County and State transportation taxes have allowed Metro to make major investments in transit expansion projects.

In addition to the tax passages, the report lists a handful of projects completed in recent years: The Gold Line Eastside Extension, the first Phase of the Expo Line, the Orange Line Chatsworth Extension, and even the opening of the original Orange Line. During his campaigns, Villaraigosa ran on doubling the rapid transit and rail system. As the chart below shows, Los Angeles County is well on the way to reaching that goal thanks in large part to Villaraigosa?s leadership.

While Villaraigosa has talked about the importance of maintaing low fares and having an expanded bus network, neither issue is mentioned in the report. As the Bus Riders Union and their allies have noted, despite the transit taxes, bus ridership has shrunk during the Mayor?s term, even if the trend seems to have reversed itself in the last two years.

Another area where the Mayor did not meet a goal was the rejection of Measure J earlier this year. While votes are still being counted and the percentage of votes in favor of extending the 2008 Measure R sales tax until 2069 continues to grow; it is wildly unlikely to cross the two-thirds thresh hold necessary. Getting the Measure on the ballot was a difficult enough feet, but it looks as though the vote will fall just short. It currently is receiving the support of 65.88% of votes counted. It needs 66.7%

Another area where the Mayor?s Office gave itself good marks was with the city?s success lobbying for federal transportation dollars. The report notes the success the city enjoyed lobbying for $130 million of American Reinvestment and Recovery Act Funds (aka 2009 Stimulus Funds) and the mixed success of the America Fast Forward nee 30/10 Plan. America Fast Forward was a plan put forward by the Mayor?s Office and Move L.A. that would encouraged a change in the federal funding formulas to benefit areas that are taxing themselves to pay for new projects. ?We?re not asking for a gift, we?re asking for a loan,? was a popular phrase used to explain the plan.

The program was a partial success. While many of the asks in America Fast Forward occured, there has not been a rush of federal dollars to Los Angeles to speed up construction of new projects. The Westside Subway and Regional Connector have received some federal transit dollars and the Crenshaw Line received a large $534 million no-interest loan, but overall Los Angeles will not see ?30 years of transit projects built in 10 years.?

Which is not to say the campaign was a failure. The America Fast Forward Campaign did help change federal policy in the 2012 Federal Transportation Bill. In short, the MAP 21 included the following changes:

  • Expands funding for TIFIA to $750 million in FY 2013 and $1 billion in FY 2014.
  • Increases the share of project costs that TIFIA can cover from 33 percent to 49?percent
  • Enables US DOT to make loans to a group of related projects
  • Authorizes US DOT to make upfront conditional commitments to projects through Master Credit Agreements making TIFIA assistance more predictable for larger, multi?year phased capital programs.
  • Authorizes US DOT to allow limited interest rate buydowns.
  • Provides $105 billion (roughly $54 billion per year) for the nation?s surface transportation programs.

However, a federal bond program known as QTIB, which reformers and Villaraigosa hopes would be expanded, was actually not included in the final Federal Transportation Bill. This program was seen as a lynch pin for AFF.

While the city did see some large victories in the transit funding arena, it has tradtionally fallen short when applying for state and federal ?Safe Routes to Schools? funds, one of the largest available pots of transportation funding for bicycle and pedestrian safety improvements. The recent hiring of two ?pedestrian coordinators? at LADOT may reverse this trend. Conversely, the Mayor?s office showed leadership in pushing for a bicycle and pedestrian set-aside in the city?s portion of the Measure R dollars. This set-aside is responsible for not just the hiring of the new coordinators, but many of the bicycle projects that have dramatically improved the Mayor?s standing with cyclists.

Speaking of bicycle and pedestrian improvements, the report is all smiles. For bicycling improvements, it?s easy to see why. The report highlights the coming bike share program with Bike Nation, the innovative Bike Friendly Street on Yucca in Hollywood, and two years of success implementing the 2010 Bicycle Plan.

This is sort of a funny graph. In 2011, advocates were told the first year of the 2010 Bike Plan was the start of the 2012 fiscal year, July 1, 2011 when they complained that the plan wasn't being implemented. Looks like we're back to the January 1, 2011 as the start date for the plan (which was signed into law in March of 2011). Regardless, the chart does tell the story of a city that is dramatically increasing its investment in bicycle infrastructure. Bully for them.

For pedestrian improvements, the record is not as clear. ?The report highlights the addition of new pedestrian oriented staff and the Sunset Triangle Pocket Park, but somehow completely misses the ongoing crisis of Los Angeles? sidewalk conditions. Officials estimate the cost of repair at $1.5 billion and there is no obvious source of funds to make these fixes.

For watchers of the Mayor?s Office or transportation policy junkees, there is a lot to digest in the report. For example, there?s an entire section on Metrolink and High Speed Rail not examined in this article. How, in the animal world, a daughter avoids mating with her father: Paternal 'voice' recognition

ScienceDaily (Nov. 30, 2012) ? Paternal recognition -- being able to identify males from your father's line -- is important for the avoidance of inbreeding, and one way that mammals can do this is through recognizing the calls of paternal kin. This was thought to occur only in large-brained animals with complex social groups, but a new study published November 30 in the open access journal BMC Ecology provides evidence in a tiny, solitary primate that challenges this theory.

The study, led by Sharon E Kessler, finds that the grey mouse lemur (Microcebus murinus) -- a small-brained, solitary foraging mammal endemic to Madagascar -- is able to recognize paternal relatives via vocalizations, thus providing evidence that this is not dependent upon having a large brain and a high social complexity, as previously suggested.

Because grey mouse lemurs are nocturnal solitary-foragers living in dense forests, vocal communication is important for regulating social interactions across distances where visibility is poor and communication via smell is limited. Though the mouse lemur shares sleeping sites with other mouse lemurs, it forages alone for fruit and insects. It is a particularly interesting species with which to study vocal paternal recognition because, in the wild, females remain in the same area of birth and cooperatively raise young with other female kin. Males do not co-nest with their mates or young and provide no paternal care, which limits opportunities for familiarity-based social interactions. Thus, vocalizations are likely to be important -- particularly for avoiding inbreeding.

The research team from Arizona State University and the University of Veterinary Medicine Hannover in Germany found that two of the most frequent calls of the mouse lemur were the mate advertisement call and the alarm call. Using multi-parametric analyses of the call's acoustic parameters, they could see that both call types contained individual signatures. Through this, they discovered that only male grey mouse lemur advertisement calls, but not alarm calls, contained acoustic paternal signatures. Furthermore, females paid more attention to advertisement calls from unrelated males than from their fathers.

The findings from the study suggest that the discrimination between mate advertisement calls and alarm calls may be an important mechanism for inbreeding avoidance. This is likely to be highly important in the grey mouse lemur species because males are likely to remain in an area for several years and they can expand their ranges to more than twice that of the female's range, making it likely that adult males' ranges will overlap with those of their daughters from previous mating seasons.

The team also proposed that the mouse lemur's ultrasonic calls above the hearing range of owls could be an anti-predator strategy, especially since the species suffers from high predation.

Lead author Kessler commented, "Given that more complex forms of sociality with cohesive foraging groups are thought to have evolved from an ancestral solitary forager much like the mouse lemur, this suggests that the mechanisms for kin recognition like those seen here may be the foundation from which more complex forms of kin-based sociality evolved."

She continued, "Future analyses will determine which acoustic parameters make this kin recognition possible by artificially manipulating acoustic parameters in the calls and then using the modified calls in playback experiments."

Junk radio signals track all space debris in one go

Call it Junk FM. Rogue signals from your radio may help warn about space debris on a dangerous collision course with Earth.

Stray FM signals from radios, bouncing back off space junk, could allow astronomers to track the whole population of space debris, suggest preliminary tests conducted this week at the Murchison Widefield Array (MWA) radio telescope in Western Australia.

More than 21,000 pieces of debris larger than 10 centimetres are currently zipping around Earth at speeds of around 7 kilometres per second, according to NASA. Friction created by brushes with Earth's upper atmosphere can sometimes cause pieces of space junk to drop from orbit, creating a small but real risk for humans.

Meanwhile, millions of smaller pieces in orbit present a serious risk to satellites. This space junk is spotted and tracked using traditional radar or lasers, but the system has its limits.

"The best techniques at the moment can track a max of about 200 bits of debris a day," says Steven Tingay, director of the MWA from Curtin University in Western Australia. "If we can get thousands simultaneously, we could almost get the whole population of space debris in a night."

The MWA is a set of some 2000 radio antennas spread out over 3 kilometres. Because of its extraordinarily wide field of view, the MWA can continuously track objects rather than just calculate their orbits from snapshots, Tingay says. That will improve our understanding of how much space junk exists and how much more is being created. "We can quickly characterise it after a launch or a collision," he says.

Continuous tracking would also improve orbital modelling in general and allow better protection of space assets, Tingay says.

To test the radio-tracking concept, the team used the MWA to pick up FM signals rebounding off the International Space Station, which is more than 100 metres wide. The team could clearly track the orbiting lab as it moved about 8 kilometres.

"This first observation gives us some great data to work on," says Tingay. Now that they know it works, the technique should be easy to scale down to objects as small as 10 centimetres, he says.

So far, the telescope has been using only a quarter of its antennas at a time, Tingay adds. Next year it will begin operating at full capacity. "The main thing the final instrument will give is four times more sensitivity, which broadly translates to four times smaller space debris," he says.

"It's a great idea," says Fred Watson, head of the Anglo-Australian Observatory at Coonabarabran. "If you're looking at the whole sky you really have the potential to map the space debris. But it's not the total panacea." There would be some lower limit to the size of debris FM signals could track, he says, and bits only a few millimetres wide can still do damage.

Roundtable panel notes how grocers are expanding in Dallas and Houston, especially in suburban markets.

The consensus from a panel of retail real state experts in Texas Real Estate Business? Retail Roundtable is that Texas, specifically Houston and Dallas, has been a target market for retail expansion for years and the momentum has not shifted. This interest in the Houston and Dallas areas is a direct product of the markets? thriving economy.

Houston and Dallas are enjoying job growth and an upswing in population, which naturally has led to increased demand for retail properties. Retailers, especially grocers, have expanded their footprint to meet the demand. Kroger, Trader Joe?s, Aldi, Whole Foods, Spouts and H-E-B, among other grocers, have all opened or broken ground on Texas locations, mostly in the suburban submarkets.

According to the Bureau of Labor Statistics, Houston has added 12,300 retail jobs in a 12-month period ending July 2012, a 4.6 percent hike. In Houston, total employment in the retail sector has increased month-to-month for 22 consecutive months. Similarly, Dallas? trade and transportation sector has added 11,900 jobs in the same 12-month period, a 2 percent gain.

In the core submarkets, the trend for retail development is more in mixed-use properties, such as BLVD Place in Houston or West 7th in Fort Worth. Retail and restaurant tenants are expanding into these high-profile developments instead of breaking ground on new developments, which the participants have attributed to the increasing cost of land and the difficult to obtain construction financing. New retail construction tends to be in the suburban markets, where land is cheaper and the population is growing more dense, according to the participants.

The following is the edited transcript of the Retail Roundtable, which features commentary from United Commercial Realty (UCR), Marcus & Millichap, NAI Robert Lynn, Baker Katz and Venture Commercial. To read the description of each participant, see the sidebar entitled ?Meet the Panel.?

For the roundtable:
1. Texas Real Estate Business: What is the health of the Texas retail market versus the Southwest and the rest of the nation?

Ken Reimer: It is pretty clear that Texas experienced little tumult relative to other regions in the last four years. We are positioned to take advantage of a recovery with our central time zone, diversified economy, Right to Work advantages, educated work force, business friendly political environment, low cost of living, and growing population.

Kenneth Katz: In general, the Texas market is healthy. We?ve had strong retail growth. One of the things that helped us in the recession is that we didn?t experience severe declines in residential values that markets in other parts of the country did. As a result, our consumer confidence and spending wasn?t as severely affected here as it was in other parts of the country. Also, most retailers report very strong sales numbers out of their Texas stores ? both in terms of absolute performance relative to other markets and profitability.

2. TREB: What retailers are expanding and where are they expanding?

Ken Reimer: Many retailers are frustrated by the lack of expansion opportunities and this has proven to be a barrier to growth for many smaller retail/restaurant concepts. There have been few new anchored developments in Texas, though grocers and discounters such as HEB, Walmart, Kroger, Aldi, and others are very actively pursuing new locations that will come online as 2014 or 2015 openings. Importantly, most of these retailers are self-developing with little or no focus on adjacent retail space.

Kenneth Katz: Grocers, fitness clubs, and fast-casual restaurants are very active segments in Houston. In the grocery sector, Wal-Mart and Kroger have been consistently active in our market. Trader Joe?s just opened their first two locations in Houston and they have a third under construction. Aldi has purchased a number of sites and plans to open their first wave of stores next year. Costco, who has been at three existing stores in Houston for about five years now, has plans to double their store count within the next 24 months. Active fitness retailers include LA Fitness, Planet Fitness and 24 Hour Fitness. Blast Fitness is a newcomer to Houston that acquired most of the Bally Total Fitness locations in our market.

3. What opportunities do you see for grocery and drug store chains in the suburbs versus the city?

Ken Reimer: It?s extraordinarily difficult to find sites inside the loop that are large enough/cost effective for both categories. But anchors such as Walmart, Sam?s Club, Kroger and LA Fitness are serving the densest areas at the periphery, while searching in the center of their target infill market. Land abounds in the suburbs, but proving up sites with limited growth is challenging.

Kenneth Katz: The majority of the opportunities for grocery and drug store growth is in the outlying suburban markets most of which are located in Houston?s extraterritorial jurisdiction. You?ll see growth in those areas for two reasons: The population will increase in the suburban markets faster than in the urban markets, and store spacing is less of a challenge compared to the urban core.

4. What uses are there for any second-generation space? Have any properties been repositioned in your market that you could mention?

Kenneth Katz: A number of spaces that were available for long periods of time are now being leased. For example, BLVD Place is now under construction. It?s being redeveloped into a mixed-use project that will be anchored by Whole Foods and Apache Corporation?s new headquarters. A former Borders at Kirby and Alabama has been leased by Texas Children?s Pediatrics. Another example is the Commons of Willowbrook at SH249 and FM 1960. The owner is repositioning that project by demolishing one large multi-tenant pad, which will enhance visibility and parking and make what was previously a difficult anchor position more desirable.

5. What retail activity is happening in the suburban markets as compared to the city? What are some of the developments taking shape in your market?

Ken Reimer: While almost every tenant would expand into denser, less competitive (per capita) infill locations, small to mid-size concepts that can generate the volume and profit to pay for more expensive infill sites have been successful. These include many ?chef driven? restaurants and fast food concepts such as Chick-fil-A, and higher-end retailers such as Room & Board. Larger retailers including Kroger, Walmart, Sam?s Club or LA Fitness are getting as close to the ?bulls eye? as possible, often serving uptown customers at the periphery.

There are many proposed Dallas-area developments, although some are two to four years off. They include Nebraska Furniture on State Highway 121; Rayzor Ranch in Denton; the redevelopment of Valley View Mall in Dallas; the redevelopment of Golden Triangle Mall in Denton; Greenway?s 1709 and Kimball project called Kimball Crossing; Margaux Development?s work on the corners of State Highways 114 and 170, and U.S. 377 and North Tarrant Parkway; LPC?s Oak Lawn development at Blackburn; UCD?s North proposed grocery anchored center at Lake Forest and U.S. Highway 380; and the Walmart development in Crossroads on U.S. Highway 380.

Kenneth Katz: Many suburban markets are experiencing continued residential growth and expansion. As the population continues grow in these areas, there is an increased need for retail services. The majority of new development to serve this increased population base is in the form of grocery store growth. As demand for space increases among fast casual restaurants and other retailers looking for regional opportunities, space at the major retail intersections that were established in the years leading up to the recession are highly sought after.

Tomball MarketPlace is a regional power-center that came online just before the recession. Although the infrastructure was complete, the project was dormant until last year. It is now close to stabilization and anchors include Kohl?s, Ross Dress for Less, Marshalls and Academy Sports + Outdoors along with a number of additional mid-size retailers. Grand Lakes MarketPlace, a Whole Food-anchored center that also features Costco Plus, Stein Mart and speculative retail space, is now under construction in Cinco Ranch. Katy Ranch Crossing is a non-traditional power center that is under construction and will be anchored by The Main Event, Baskins, Goodwill and Spec?s. Another noteworthy project under construction is South Park at Cinco Ranch, a Kroger and Academy-anchored development.

6. As far as troubled shopping centers, are they an opportunity or are they an issue? Why?

Ken Reimer: As the margin for error has become much smaller, retailers today break fewer and fewer rules and more than ever stick to spaces with excellent access, visibility, signage and traffic. Centers that broke many rules with some success (some with less success), will continue to be challenging for retail, but perhaps better positioned for alternative uses that are not as dependent upon convenience and visibility (office, medical, dance studios, etc).

Kenneth Katz: There are a number of opportunities for troubled centers to be turned around and repositioned. For those centers that just haven?t received the investment and expertise they need in order to be turned around, opportunity exists. Where opportunity might not exist is with those centers that are located in trade areas where demand is light or where the projected increases in occupancy and rents do not justify the investment.

7. Are foreign investors looking into Texas markets for opportunities? Which ones are interested in your market?s properties?

Ken Reimer: I?ve noticed a lot of foreign money is being spent by Middle Eastern, Asia and California money sources.

8. How easy are acquisition and/or construction financing to come by? Is it easier for buyers and developers to borrow compared to this time last year?

Kenneth Katz: Construction financing to acquire raw land or substantially empty buildings is still very difficult for most borrowers. For projects that are stabilized, financing is as available and attractive as it has ever been in recent history.

9. What do you feel like will be the big story of 2013 as it relates to the retail market in your city?

Ken Reimer: I suspect that very few new developments with tenants will open in 2013, but many will be coming on line in 2014.

Kenneth Katz: One of the major stories in 2013 will be the long-awaited increase in the pace of development. In the next 18 months, Houston will likely see 11 or 12 new sizeable projects. That is a significant increase over the six new centers that were developed in the last four years combined. Another continuing story for Houston is the new Exxon Mobile corporate campus south of The Woodlands. That move will bring 12,000 employees into the area. It?s going to be interesting to see the impact of this move on both the housing market and the retail market.

Attorney expects Lohan will be cleared in NYC case

LOS ANGELES (AP) ? An attorney for Lindsay Lohan says he expects the actress will be cleared of a charge that she hit a woman in a Manhattan nightclub.

Lawyer Mark Heller said Thursday that Lohan is being targeted because of her fame.

The "Mean Girls" star was arrested by New York police around 4 a.m. Thursday and charged with third-degree assault, a misdemeanor.

The woman in the club did not require medical attention, and Lohan was released hours later.

Prosecutors in Santa Monica also charged Lohan on Thursday with lying to police and reckless driving involving a June accident on Pacific Coast Highway.

The charge could trigger a probation violation and another jail sentence for the 26-year-old.

Indian board rejects AstraZeneca's patent plea on cancer drug

(Reuters) - India's patents appeal board has dismissed British drugmaker AstraZeneca's petition challenging an earlier ruling that refused patent protection for a cancer-fighting drug, in the latest blow for Big Pharma in the country.

The Indian patents office in 2007 refused patent protection to AstraZeneca's quinazoline molecule, citing lack of invention. The Intellectual Property Appellate Board (IPAB) on Monday upheld the refusal.

The decision is also a setback for struggling AstraZeneca, which is battling to turn itself around as key drugs lose patent protection.

Global drug companies suffered a high-profile reversal in March when India granted the first ever compulsory license to domestic drugmaker Natco Pharma to sell cheap copies of Bayer's cancer drug Nexavar. Bayer has appealed the order.

And early this month IPAB revoked a six-year-old Indian patent granted to Roche's hepatitis C drug Pegasys, citing lack of evidence that the drug was any better than existing treatments.

Multinational drug manufacturers regard India's $13 billion drug market as a huge opportunity, but are wary of what they see as lax protection for intellectual property in a country where generic medicines account for more than 90 percent of sales.

Indian generic companies, which do not need to plough money into future research, can produce drugs at a fraction of the cost of originator firms like Roche or Bayer.

Natco and another domestic drugmaker, G. M. Pharma, had opposed the initial patent application for AstraZeneca quinazoline derivative. The London-listed company filed a review petition, which India's patent office dismissed in 2011.

A challenge to a review petition does not come under the purview of the IPAB, and even on merit the petition has failed, S. Majumdar & Co, the counsel for Natco Pharma, said in a statement.

AstraZeneca could not immediately be reached for a comment by Reuters. The company has the option to take its case to India's Supreme Court.

How to buy an ethical diamond

ScienceDaily (Nov. 27, 2012) ? You've already decided that you're going to pop the question. Now comes another quandary: Where to get the ring, if you're buying one?

The holidays are a busy time for engagements, and Trina Hamilton, a University at Buffalo expert in corporate responsibility, says socially minded consumers have a lot to think about when it comes to finding the right rock.

In recent years, shoppers have turned to Canadian diamonds as news reports and movies exposed the diamond trade's role in fueling armed conflicts in developing countries. (Think "Blood Diamond," the 2006 thriller featuring Leonardo DiCaprio as a diamond smuggler in 1990s Sierra Leone.)

But Hamilton says choosing an ethical diamond is more complicated than avoiding war zone stones.

"Many people who are planning proposals choose Canadian diamonds because they don't want anything tarnishing the story of their engagement, but doing the least harm doesn't mean you're doing the most good," says Hamilton, an assistant professor of geography.

Ethical options for today's consumers extend beyond Canadian diamonds.

In a survey of 94 diamond retailers who promote themselves as ethical sellers, Hamilton and her students found that 13 were marketing ethical stones from countries other than Canada, including Botswana and Namibia. These two African nations have been recognized for using the diamond trade and associated revenues to create jobs and fight poverty.

Even in Sierra Leone, there are efforts to develop "fair trade" diamonds, and some analysts suggest that diamond exports have helped to fund reconstruction since the country's civil war ended in 2002, Hamilton says.

"Consumers need to decide what they want their money to do," Hamilton says. "Starting in the late 1990s, Canada quickly cornered the ethical market. But now there's a bit of a backlash: People have concluded that it's not addressing the issue of development of these African countries that suffered during the conflicts, and they're also starting to question whether Canadian diamonds are as conflict-free as is often claimed."

If you're shopping for a diamond this holiday season, here are some tips from Hamilton:

Look Beyond 'Conflict-Free': Many retailers boast that they comply with the Kimberley Process, a certification scheme designed to prevent the trade of "conflict diamonds." But Hamilton says this is the bare minimum. Because the Kimberley Process defines "conflict" very narrowly, it doesn't address concerns like government-fueled human rights abuses; labor standards; or environmental impacts, she says. Shoppers should be aware that countries without Kimberly-designated conflicts are not necessarily free of other problems.

Don't Settle For a Gift to Charity: Twenty-one of the retailers Hamilton surveyed donate a percentage of profits to charity. This may be a commendable add-on, but in and of itself, "it's not addressing industry practices within the diamond trade," Hamilton says. Finding retailers who are also engaged in initiatives to improve social and environmental standards within the industry may be a more effective way to produce social change, she says.

Remember That Activism Matters: Consumer spending is an important way to influence business decisions, but people who are passionate about a cause shouldn't stop there, Hamilton says. Protests, and other forms of direct activism, are also a critical part of changing the industry and addressing broader issues of social and environmental justice, she says.

Hamilton emphasizes that there's no single answer as to what constitutes an ethical diamond. Consumers will arrive at different decisions about what to buy based on their specific social and environmental concerns, she says. She notes that even in Canada -- where the diamond in Hamilton's engagement ring was sourced -- mining of the stones has caused some strife between companies and indigenous communities.

Besides diamonds sourced from countries of interest, Hamilton's survey of 94 sellers found that nine offered recycled diamonds, such as antiques, while six sold lab-created diamonds. The survey -- part of an ongoing study -- was based on retailer websites, with the researchers doing an in-depth analysis to identify product offerings, marketing strategies and discussion of ethical issues.

Hamilton's partners on the project include UB PhD candidate Seth Cavello and UB undergraduate student Christine Tjahjadi-Lopez. The work was supported by the UB Humanities Institute, Baldy Center for Law and Social Policy, and Canadian-American Studies Committee.
